In the case of Intellectual Property, the government provides the following protection:

IP protection in India is governed by the Patents Act, Trade Marks Act, and Copyright Act, which are in conformity with the international standards. Intellectual Property can be protected as follows:

  • Trademark: Register with the Indian Trademark Registry. Application fees start as low as Rs. 4,500/- if done online. Automatic protection is granted from the date of filing.
  • Patent: File with the Indian Patent Office. 'First to File' is the rule. DPIIT recognizes startups and provides an 80% rebate on the fees.
  • Copyright: Automatic. Registration is recommended.
  • Trade secrets: This can be done through employment contracts.
