    Overview of MSME Registration


    MSME sector comprising of micro, small and medium enterprises is the backbone of the Indian economy. MSME sector is regulated by the Micro, Small and Medium Enterprises Development (MSMED) Act, 2006. Whether an entity is a micro, small or medium enterprise depends on the value of its investment in plant and machinery or equipment and annual turnover. Under the new definitions, A composite criterion of investment and turnover shall apply for classification of an enterprise as micro, small or medium. The threshold limit for investment in plant and machinery or equipment and annual turnover is as follows:

    Manufacturing Enterprises and Enterprises rendering Services

    Micro Enterprise

    Investment in Plant and Machinery or Equipment:
    Not more than Rs.1 crore and

    Small Enterprises

    Investment in Plant and Machinery or Equipment:
    Not more than Rs.10 crore and

    Annual Turnover: not more than Rs. 50 crore

    Medium Enterprises

    Investment in Plant and Machinery or Equipment:
    Not more than Rs.50 crore and

    Annual Turnover: not more than Rs. 250 crore

    Who can apply for MSME Registration

    In terms of the provisions of MSME Act, “enterprise” means an industrial undertaking or a business concern or any other establishment, by whatever name called, engaged in the manufacture or production of goods, in any manner, pertaining to any industry specified in the First Schedule to the Industries (Development and Regulation) Act, 1951 (55 of 1951) or engaged in providing or rendering of any service or services. Thus, all types of enterprises whether proprietorship, HUF, AOP, Co-operative societies, partnership firm, company or undertaking whether in manufacturing sector or service sector by whatever name called can apply for MSME registration.

    The information sought is on self-certification basis and no supporting documents are required at the time of online filing of application.
     
    With the enactment of the Micro, Small and Medium Enterprises Development (MSMED), Act 2006, for the goods and services supplied by the MSEME units, payments have to be made by the buyers as under:
    1. The buyer is required to make payment on or before the date agreed on between him and the supplier in writing or, in case of no agreement, before the appointed day. The agreement between seller and buyer shall not exceed more than 45 days.
    2. If the buyer fails to make payment of the amount to the supplier, he shall be liable to pay compound interest with monthly rests to the supplier on the amount from the appointed day or, on the date agreed on, at three times of the Bank Rate notified by Reserve Bank.·  
     
    Udyog Aadhaar registration is nothing but the registration obtained under Micro, Small and Medium Enterprises Development (MSMED), Act 2006.
     
    Yes, Aadhaar is mandatory for MSME registration.
     
    Ministry of Micro, Small and Medium Enterprises vide its Notification No. UAM/MC/01/2017-SME dated 27.06.2017 has provided that MSME registration shall not be applicable on enterprises engaged in following sectors:
    1. Forestry and Logging
    2. Fishing and Aquaculture
    3. Wholesale and retail trade and repair of motor vehicle and motor cycles
    4. Wholesale trade except of motor vehicles and motor cycles 47
    5. Retail trade except of motor vehicles and motor cycles
    6. Activities of households as employees for domestic personnel
    7. Undifferentiated goods and services producing activities of private households for own use
    8. Activities of extra territorial organization and bodies

    No, registration of an enterprise under MSMED Act, 2006 is voluntary.
