A non-resident must file an income tax return in accordance with the rules that apply to the comparable resident assessee if they have income that is taxable in India. But let's say a company is recognized as a fiscally transparent business under the terms of a DTAA that India and a foreign government signed (in which such a firm is a resident). In that situation, the return must be filed in accordance with the partner's status within the company.
